In our consideration:
The civil society representatives democratically elected to the dialogue table of Ilo, in deference to this mandate and the need to adopt the final agreements in the negotiation process between the Southern and civil society of Ilo, we performed the assembly of delegates, where we present information the dialogue process and proposals made by various actors in search of adopting participatory decisions on behalf of the town of Ilo.
Ilo civil society has shown for more than 4 years a tolerant and dialogue in search of arrangements for the benefit of sustainable development of our city and region. Despite public statements by breaking the space for dialogue by the company, we have insisted on retaining the Bureau and was successfully completed by filing alternatives and proposals, such as the Framework Convention on projects including economic, social proposed by environmental and civil society.
reiterated regret the Southern attitude not to sign the Framework Convention, stating that it is signed authorities and civil society, since the main parties in this Roundtable include business and civil society. With this, the Southern assumes no financial commitments for the implementation of projects requested by civil society and feel Ilo circumvented the demands of the population, after decades of environmental impacts affecting the economic, social and health population, reasons that led to the talks.
In this situation, the Assembly reached the following agreements:
1 .- Civil society representatives should not sign any final agreement document, not to express a serious and responsible party of the company.
2 .- Require local and regional authorities involved in the Roundtable to refrain from signing this agreement, not having made an inquiry to gather the opinion of the population.
3 .- Report the company to national and international bodies showing their irresponsible towards society and the local environment. Sincerely

Today members of the Roundtable met at the Municipal Auditorium at 12:00 Pacocha days previously Mr. Alejandro Leon Palomino, coordinator of civil society representatives presented a document to the Vice Minister of Mines, Dr. Felipe Isasi Cayo.
Mr. Vice Minister of Mines opened the meeting by reading the documents of agreement and stating that this was a meeting about protocol also read the paper presented by civil society. Read the Framework Convention and the Final Act. He suggested that those who agreed to sign this document and civil society if he could change his mind so he could do.
The civil society representative requested Mr. Alejandro León word and then ask for the understanding of all members of the Roundtable was to know that civil society representatives were leaving because they had to fulfill the mandate of the people of Ilo not to sign any document because it did not reflect the demands of the population of Ilo.

CONVENTION No. 001 - MDA ILO
FRAMEWORK CONVENTION DIALOGUE TABLE OF EXTENDED
ILO certifies this, the Framework Convention celebrating all members of the Roundtable Expanded Ilo, about agreements and commitments signed during the negotiation process of the same, under terms and conditions:
CLAUSE ONE: PARTICIPANT
1.1 .- SOUTHERN PERU COPPER MINING COMPANY CORPORATION, is a legal entity under private law, linked to the category of mining, who has a particular impact on the Ilo Province because of their inherent activities. Hereinafter referred to as THE COMPANY.
1.2 .- GOVERNMENT, who participate through representatives of the Presidency of the Council of Ministers and the Ministry of Energy and Mines.
1.3 .- REGIONAL GOVERNMENT MOQUEGUA is a legal person of public law to political autonomy and economic management in accordance with the provisions of Law No. 27867 Organic Law of Regional Governments, and their purpose essential to promote sustainable integrated regional development, promoting public and private investment and employment and ensure the full realization of equal rights and opportunities of its inhabitants, in accordance with the plans and programs, regional and local development.
1.4 .- Provincial Municipality of ILO are legal persons of public law to political autonomy, administrative and economic, as provided in Act No. 27972 Organic Law of Municipalities, and its aim to promote local development and the provision of services public responsibility, in line with national policies and plans and regional development.
Pacocha DISTRICT MUNICIPALITY AND Algarrobal are legal persons with autonomy Public policy and economic management, being a basic entity of the territorial organization of state and immediate channel of neighborhood participation in public affairs, as provided in Act N º 27972 Law of Municipalities, and its aim to promote local development and the provision of public services under their responsibility, in line with national policies and plans and regional development.
1.6 .- CIVIL SOCIETY MEMBERS are individuals elected democratically by the people of Ilo as their representatives to the Roundtable Expanded (MDA) of Ilo. 1.7 .-
Ombudsman is an independent constitutional body whose mission is to protect the constitutional and fundamental rights of the individual and the community, monitor the performance of the duties of public administration and the provision of public services to citizens , participating in this convention as an observer of the process.
ARTICLE TWO: PURPOSE AND SCOPE OF AGREEMENT
2.1 .- The present Convention is to establish the conditions and obligations of participants, commitments, projects or mechanisms and contribution limits, contributors, accordance with the objectives and commitments adopted by the Roundtable Expanded Ilo.
2.2 .- Our aim is to bet Convention sustainable development of the province of Ilo, through the contributions that the Company and public entities assume.
2.3 .- It is understood that the company's economic contributions and covered by this Agreement are independent of those made by it in Miners Solidarity Fund Minera or under another legal mechanism. Nor is
tax credit of any kind.
2.4 .- The implementation of this agreement is mandatory and binding on the participants and is subject to surveillance and social control at all times committing the parties to provide information and other developments of interest of any person or entity.
ARTICLE THREE: TERM OF AGREEMENT
3.1 .- This Agreement is for the time spent by THE COMPANY in the province of Ilo, must develop in a sustainable manner over time.
SECTION FOUR: FINANCIAL CONTRIBUTORS AND METHOD
4.1 The financial contributors of this Framework Agreement and responsible for implementation of projects to be noted are:

- Solution to the problem of sanitation for the province of Ilo and implementation of the PMO (Optimized Master Plan).
- Construction of the Hospital of Ilo and equipment.
- Development of the agro-export (Lomas de Ilo)
- Development of mariculture.
- Construction of the fishing pier.
- Capacity Building social.
- Construction of the coastal road north (Ilo - Camaná)
- Contribution to local PP for the implementation of projects throughout the lifetime of the company.

SEVENTH CLAUSE: THE PENALTY FOR BREACH
If undue delay in the implementation of the obligations agreed upon for reasons attributable to the company, it is obliged to pay the Expanded Dialogue Roundtable is a penalty for each day of delay , reaching a maximum amount equal to ten percent (10%) of budget pledged by it in the project to execute.

According to the terms of the following clauses:
FIRST - BACKGROUND:
1.1) The Roundtable Ilo (MDI) has reviewed the space needs of the province of Ilo in the four areas and, based on this analysis, it has initially prioritized sanitation sector to improve the quality of life of all people, pending the other axis. These priority projects are:
a) Construction and rehabilitation of the sewage plant - SNIP 56001,
b) drinking water treatment and wastewater from the Algarrobal
c) Driveline drinking water Pasto Grande;
These priority projects are hereinafter referred to cone "Projects"
1.2) in the MDI Session Tuesday July 22, 2008 was accepted the company's proposal SPCC Partners in funding the projects. This co correspond to no less than a third of the cost thereof.
1.3) Existing financing of the project, a party is pending funding. - partners in Project financing
- Grant permissions that are under its jurisdiction
- Provide other facilities for the execution of projects
3.2) Obligations of the MPI, MDP and MDEA:
- partners in financing the Project
- grant permissions that are under its jurisdiction
- Inform the public about the projects run
- Provide other facilities for the execution of projects
3.3) obligations of the Company:
- Support the authorities in developing out its administrative responsibilities
- Provide information to the public about the projects in order that they are prioritized in the respective budgets participatory.
FOURTH - TERM
The parties agree to implement the actions described above and intended for execution of projects as soon as possible, while meeting deadlines and applicable legal requirements.
FIVE - PROJECT IMPLEMENTATION
Once you have been coordinated and expressly provided full funding for the implementation of projects, or each of them, the parties to co-participate in financing the project shall conclude a specific agreement for its implementation .
The Convention contains specific obligations and commitments of each party to achieve the successful implementation of the Project.
SIXTH - INVOLVEMENT OF OTHER ORGANISATIONS
If another public entity required to participate in co-financing of projects, the commitment will be implemented at the time of signing the specific agreement for the implementation of each project. The same procedure was carried out for the partnership to have a private company.
